You can also threaten them into reducing your initial bills, as if they profit from the fact that your sim card was stolen they can technically be prosecuted under the proceeds of crime act.

Of course they will bankrupt you in legal fee's before you ever got to court, but they generally don't like a fight. There are alot of other points you can bring up if you get to talk to someone with some power.

You shouldn't need to bring a private prosecution in this instance (this should be brought by the Crown on the event that Vodafone are benefiting from the proceeds of crime).

Don't make any threats at this stage. I would, however, imply that you are currently considering referring the case to the Commerce Commission (though I think that most first instance claims are heard by the Telecommunication Disputes Resolution service which Pee referred you to above).

TDR requires that you have already complained to the telephone company as well. Though I think your efforts to date should be sufficient for that.

Yea Vodafone is still a member though, It quickly starts to cost the telco alot if they don't sort it out, which puts alot of pressure on them straight away.

I always find threatening helps, worked for me so far... you can always resort to sim card cloning, setting up your own 0900 and dialling it to recover your funds... although two wrongs don't make a right.... apparently :twisted:

Yea he sells a shitload no doubt of T-Shirt's and merchandise just to go out of his way to defraud a phone company while on a trip to Fiji.... :roll:
