Bodybuilder Justin Rys, whose jail sentence has been cut from 10 and a half to 7 and a half years, has a mental disorder called megarexia that means he sees his bulging muscles as puny.

A psychiatrist's report about the disorder was given to the Court of Appeal judges who yesterday reduced the former Mr New Zealand's term, meaning he will first be eligible for parole in July next year.

Rys, of Waikanae, had pleaded guilty to importing the class B drug fantasy over a 15-month period, in amounts thought to be worth at least $600,000 and perhaps up to $2 million, to use himself and to sell.

He appealed against the 10 and a half year term on the grounds that it was excessive, especially given new evidence about his physical and mental state.

The court accepted the sentencing judge had started his calculation for the term too high, resulting in a "crushing" end sentence for Rys.

It said the new psychiatric evidence was more important than the heart condition to the sentence appeal.

Rys became hooked on fantasy when it was legal.

In 2002 it was made illegal but Rys continued to use it for purposes that included reducing pain while exercising.

Psychiatrist Dr Tony Marks had said Rys' drug crimes were largely the result of his untreated and unrecognised "muscle dysmorphia" known as megarexia.

His disorder was the catalyst for the drug addiction, Dr Marks said.

"Mr Rys maintains a delusion that he is small and tiny, when physical appearances suggest the contrary," the Court of Appeal said.

Cardiologist Professor Stewart Mann said Rys's heart was also damaged, almost certainly because of his use of anabolic steroids and other drugs he used to help his body building.

Rys' lawyer Christopher Stevenson said the effect of the evidence was that Rys may die in prison and will probably only live for five to 10 years more.

However, the Court of Appeal said his condition seemed to have stabilised, perhaps because he did not have access to drugs in prison.

Rys' drug counsellor Roger Brooking wrote that Rimutaka Prison recorded Rys as having raised cholesterol levels, breathlessness and dietary problems in 2006.

Fair move to cut his sentence. It more fairly reflects his crime now.

What do you think would have been a fair sentence for someone charged with over 100 cases of importing and supplying over $2million worth of drugs, money laundering, and obstructing the course of justice?

While it may "only" be a class b drug I think you'll find most p dealers aren't getting caught for importing $2million worth of p.

This guy got 16 years for importing $650k worth of meth http://www.nzherald.co.nz/section/1/sto ... &objectid=

And 7 months prior to getting caught Rys had served a 6 month suspended sentence for importing GH so it wasn't his first drug offence.

If heavy P dealers are only getting 5-7 years then I'd say that they got lucky and didn't get enough of a sentence. However I wouldn't justify Rys getting a short jail sentence just because it doesn't seem fair to lock him up for 10 years compared to what other drug dealers get. Unfortunately Rys' physique would have been his own worst enemy in the court room - it would have been like an axe murderer taking an axe to the court room every day and wondering why the jury was so hard on him.

You have to also take into account the fact he does not have much longer to live, was heavily addicted to the GH and gear and has been seeking help. P dealers may get longer sentences but I know which is more potentially dangerous and deadly. Anyone cut of the hand of someoneone while on gear? I think not.

I'd like to know exactly what situation his health is in. I'm sure the defending lawyer would have dramatised that as much as possible at his appeal to get more leniency.

I agree his physique would not have helped & he was very silly considering he was already under the eye of the police due to his previous offending.

I agree, i dont think he was hard done by at all. $2 million is not personal use, just greed, if I remeber rightly there were other related offences even before the GH one.

this should have nothing to do with it, y should a guy whos gonna die soon get a less of a sentence than someone who has got ages to live???

i know, i was saying imo i dont think it should be taken into account.

hes just an idiot for getting caught really, thats wat happens when u get too greedy for money. u can sell bit of roids and other shit and be sweet as, make abit of cash to support your own use. but when u start going over the top and making a living off it then its only a matter of time before shit hits the fan (unless u have it all sussed out of course and not just think u have it sussed lol)

there was a place that got raided in auckland not so long ago due to people getting greedy so that is the way it turns out.

hes a fool imo and y shouldnt he pay the price..

i say hang the p dealers /makers they are scum, the stuff he was bringin in is nowhere near as destructive as what these clowns brew up while there kids are sleeping in the next room , his only crime i say is being a tad greedy .

maybe the p dealers are getting the drugs to make the p off the bodybuilders... ever thought of that?
