Stupid Contracts

Made an appointment at Miada in Avondale, was keen as to sign up (walking distance from home... sweeet) and the guy tells me 1. I can't have a trial and 2. if I want to cancel, I need a doctors certificate or proof of moving.

He also wouldn't let me take my contract away to look at. I didn't sign up there and then, obviously. I haven't changed gyms in over 2 years, so is this usual practice? What's going on?

looks like the gym doesn't want to get any new members, maybe talk to the manager of the gym ?

There was an article on Monday in the NZ Herald about this sort of thing.

NZ gym industry told to shape up

Kiwi gyms are being warned to shape up or face prosecution after an investigation found some gyms may be breaking consumer credit law.

The Commerce Commission says it has investigated membership contracts at 13 gyms across the country and found consumers in all but one of those cases weren't being made aware of the true cost of their contract.

The contracts failed to advise customers of their statutory right to cancel the contract, and failed to disclose the full cost of the membership for the minimum period, the Commerce Commission said.

The investigation was prompted after some consumers complained about the difficulty and, or expense they had when trying to cancel their membership.

had a idiot at the les mills in takapuna tryna sign me up , went in for a look and he was determined to get me on a 12 month programme... he was very pusshy pretty much signed me up an tryed to get my bank details then an there, i said hey i wanna have a think about it and na he didnt want that, i said i didnt have my account details so he tryed to get me 2 go on internet banking haha i said i dint hav my log in.... so he said 2 ring the bank to get my account details :shock: wtf!!! I Said they myt be in the car wait there......i took off thnking wat the f*ck was that.. litlle while later got a txt frm this guy saying did i scare u off?? i ignored it then 5 mins later he rings me i ignore this idiot,,, an half hour later i get a blocked call i ansered it and he was going on about wen culd i get in for an appointment bla bla i told him i aint interested WTF!!!!! any one else had this?? haha

lol same thing in taka a while back, just went in to trial workout, gave me a free session , hounded me every day for a week till i told him not to call me again or i'd come back in and have words man he was persistent ( aye Michael?)

Big gyms usually do trials but smaller ones not a good idea as your giving away something for free. Working in a gym the number of people that sign up after our trials (which is a 5 day period valued at 70bux) is very slim. In regards to your contract, that would only apply to cancelling before your minimum term ( from miada there are 12, 24 and 36 month contracts) If you really wanted to join you would of. And remember all you are is just a dollar sign there will always be someone to take your place so I dont think Dales going to care very much if you dont sign up.

Loveeggs, the same thing happened to me when I went in for a trial at Exodus, the dude hounded me when I first went in, he tried getting my bank details etc. and I told him I'm still a member at my old gym but it expires soon, and he tried getting me to set up a automatic payment for then. After my trial was done he called me everyday for about two weeks as I continuously ignored him. :shock:

They all sound like stalkers or scammers!

That guy at Les Mills sounds like a date rape predator, hounding guys for memberships and then next step is to invite you back to his place for a workout. :?

I think they all need to open their eyes.

They charge unreasonable amounts. They have their initial set up costs, then weekly overheads, but they looking to be millionaires before helping us out.

shameful.

Places like Les Mills and Bodytech need to get a life, but then fancy pants peeps go for the uptown image and fashion workouts.

I am almost fully working out at home now. Just need the bench, and an upgrade to Oly bars.

Doubt it was a club physical that breached - their contracts are structured in a way in which the client adds a signature in certain boxes on the agreement to acknowledge the cash out clasue and costs etc. The only thing it does state is the overall cost of the contract. Likewise I dont think Les mills have it on theirs.

The easiest way to circumvent it is for gyms to sell their term memberships under a "hire Purchase Agreement" and charge the cash rate for 12 months with interest. The great thing about that is the finance company can pay the owner up front for the contract at a discounted rate. win/win.

Was an idea I had a while ago but didn't get a chance to follow up
