emc thats tough man these fucken gyms dont realise us long standing members keep people coming into the gym and when we advise the need for new things etc its because we KNOW we need it we are on the floor every day doing it not behind the counter doing f*ck all Im glad you walked out its the principal of the matter isnt it!!!

Im in a bind at the moment the manager wont get any olympic rubber plates for our deadlifts so bang goes the hard rubber ones onto the mat every time im doing a heavy set I pay my fees I expect to be have the equipment required to do the job at hand!!!

Could be a new thread starting here I think lol anyhow tin lifting time YEAH HA!!!!!!!!!

bro at my gym for the last 2 years theres been a 12.5 kg db missing so we had only 3 that makes only 1 pair and hes spent thousands to making the gym more glamorous eg a walled biking area with brand new expensive electrical bikes...wtf?? :x f**k them...glad i left...mind you it was about time as i only stayed there for this last year because the membership fees were cheap and it was a big gym...it wasnt the right atmosphere for me to continue at the level im at now.

Here is there attached message supposedly from their lawyer

Statement

Exclusion of persons from clubs

1. Les Mills is entitled to exclude persons (including existing members) from clubs any time it chooses, provided it does not exclude members based on any of the prohibited grounds for discrimination set out in the Human Rights Act 1993. Note that these grounds do not prohibit the exclusion of persons who might fall within a category addressed by them, where that exclusion is based on other grounds.

2. Where a decision is made to exclude a person from a Les Mills club, Les Mills is not obliged to give any reason for the exclusion although it might choose to do so, particularly in relation to problem conduct by the member.

3. Les Mills is required to exclude persons in situations where the health or safety of any person is at risk. This includes the health or safety of the person being considered for exclusion, and also includes issues such as harassment of other people in the club, or conduct which is dangerous.

4. Similarly, any person will be excluded from a club who engages in serious or repeated behaviour which Les Mills believes is likely to offend members.

Would have thought banning you based on a criminal record was a breach of your Human Rights (your lawyer should know this). May pay to make a complaint to the Human Rights commission, they don't stuff around with stuff like this.

Unfortunatly they are well within their rights you dont need a reason to trespass somebody from a location

I thought they may have taken you aside and retiterated they gyms policies on stuff like drug sales etc just to cover their back, but I thought having a big guy in the gym like you would be good for business, it shows their gym can make people BIG.

This happens every where I heard of people being asked to leave gyms due to PTs feeling they were taking business away from them by giving advice to people fo free, and unsubstansiated drug dealing claims getting people excluded. At the end of a day I guess its a private club and they can choose who they have there

I dont think fair go or the papers will really care. Look at womens gyms they completly exclude men which you would think would be a brach of human rights but they are private clubs so they can.

Same with the kkk and black panters :pfft: :pfft:

Take it to the papers, the herald would love it i suspect.
fair go? :P

I'm picking the general public wouldn't give a rats ass about Justin's situation, particularly if the Les Mills PR machine & legal team fronted up with their case. Lets not kid ourselves that they've been so successful as a commercial entity by sheer luck!

I'd side with this, really Justin doesn't stand a chance of doing much other than being a pain in the ass to the LM legal team.

However JimJim I have to disagree re: big guys being good for business. Most commercial gyms want to avoid BBers & PLers like the plague. The focus is "fitness" and apparently anyone excelling in BBing or a strength sport is intimidating to clients! Strange I know!

Thats why when you find a friendly gym you should appreciate it! In the US its outa control - try googling LUNK ALARM!!!!

As much as it probably pisses you off BK, you should find another gym, let bygones be bygones & get in some phenominal shape for whatever Pro Show Moe can organise in NZL - it's been far too long since we've seen you on stage! Maybe Bluto or one of the other Wellingtonians has a better gym suggestion for you? Alternately have you still got the training studio (or gear from it)? You could take the training underground Big Kiwi style!

Nate

PS - that fiji tan faded yet big guy?!

On a side note a guy can actually get into contours. Sex is one of the prohibited bases of discrimination under the HRA. Though it would be a dick move to try.

You recon a guy can join contours? As they are a private club they can turn away anybody they want the trick is not to do it on sex, then human rights commission wont get involved. They just wouldnt let you join and they dont need to give a reason.

This is like any store/private place the legal occupier can turn anybody away and they dont need to give a reason.

Just because they ask a man to leave a store doesnt mean the HRC will get involved. Would be a different story if they said you have to leave because your a man or had signage up stating what sex or races etc could enter.

Yea, I agree, they could legitimately turn a dude away on grounds other than sex/gender. But if you tried to bring a claim that would have to be able to make out those grounds. It would have to have some legitimate basis.

Though I guess it wouldn't be hard something along the lines of intimidates other members should suffice.

all very interesting points you def can't descriminate on sex even if it is a private club you will get your ass handed to you. Legally a guy could def join contours :)

But leaglly the club doesnt have to accept your custom.

One thing that gets me is the NZ Maori Rugby team! How is this not a breach of human rights Id love to see the NZ caucasian Rugby team there would be all kind of protests!
