I reckon, We are that PC now that someone can hide behind a supposed fear of closed spaces and booze to avoid taking responsibility for their actions and get away with taking a life. It's a joke!

I think ordinary NZers are sick to death of this BS!

As an adult you are accountable for your actions and you have choices, she should either be sent down to jail or if she is using mental incompetency as an excuse then she should spend the jail sentence in a mental health ward IMO.

How is home detention for a person who is at home looking after her mum already a sentence?

Once again the victim and their families rights have been totally ignored.

Bring back old school hangings ect. Theft and you lose and hand, murder and your shot, beheaded etc. Rape and you lose your .. yea.

How many thefts, murders, rapes would there be if this was the case?? Zero, political bullshit and now some idiot woman gets away scot free.

Isn't New Zealands government pathetic. I bet if it was a cop she hit and killed it wouldnt be the case

A cops job is getting tougher and they're being given less and less backing by the justice system for what they have to deal with every day.

I dare say if it was a cop in the same circumstances the penalty would be the same. The circumstances in the recent Porirua case are very different, which im sure you are referring too, but will probably be years from sentencing.

I agree totally with the thread starter, pathetic sentence!

It doesnt reflect the complete loss of an innocent life at the hands of a completely irresponsible #$#$$@

As a person who has been in the justice system some of the sentences are mad thats for sure. Even I wonder how they come about some of them. One thing you do see is that males and females are sentenced at different levels even though they are supposed to be equal. Yep I have been in jail for drugs and drugs are deffinately not a good thing but I see rapists, murders, petifiles, white collar crimainals who get sentences that are just nothing in comparison to what their crime was.

They started my sentence at 13 1/2 years and got dropped to 10 1/2 years from pleading guilty. The only reason I am out now is because of winning my appeal otherwise I would be still in there for many more years. Yes some of the sentences are crazy that;s for sure :)

Most definitely agree with you on this!! Our justice system needs some work :x

Its like hallo if she has a mental ilness as she states where she has panic attacks when away from a place of safety, that is all fine and well BUT what the heck was she doing cruising about in her car at 100km+? What a crock of shit!

And the article defines Agoraphobia as:

A fear of open spaces, going outside or being away from a place of safety. Also an abnormal fear of being helpless in an embarrassing or inescapable situation.

Yet, she was outside and under the influence of alcohol in a moving vehicle. You'd think that was a pretty helpless/inescapable situation? :roll:

I don't know anyone with Agoraphobia, and its probably much worse than I'm making it sound.. but I really think the judge should've sided with the victim/victim's family in this case. NOT the fricken driver's fire.gif

Being 42yrs old, she's old enough to know the law and the difference between right and wrong :evil:

Judge Wiltens also took into account her early guilty plea and the fact she was caring for her cancer-stricken mother.

if her mother is so cancer stricken why wasnt Ms Caudwell looking after her the afternoon of the crash?

i wonder what cancer her mother actually has? it musn'tbe soo serious that she needs 24hour care otherwise Caudwell wouldnt have gone on the red wine fender bender.

More over, her home detention means she will have access to home ammenities (telly, shower, couch, food) and will be in contact with her mother-no isolation to reflect upon her actions-merely 12months comfy retreat in her home.

Big Kiwi is right, the sentence doesn't fit the crime.

How would the judge feel as the husband of a victim in the same situation?

You can all but guarentee he would be pushing for a maximum sentence and crying foul if that wasn't administered.

The guy said he was moved to tears by the victims families statements yet still gave the lady little more than a slap on the hand, what a joke!

We all have stress and issues in our lives; how we deal with them shows our character.

To drink 3X's the legal limit then drive, kill someone then hide behind an excuse iand issues is pathetic, but garbage like this is becoming increasingly more prevalent.

Does that mean we all can have some tough times, kill someone and then not be accountable for our actions?

Guess what, as a supposed care giver, she will probably still be allowed out for a couple of hours each day to shop, pick up prescriptions etc.and we as tax payers will be paying for this. What a joke.

Now this case will probably be case law and just how many future defence lawyers will use this as an example to get their clients of a vehicular manslaughter charge?

The victims family gets no closure, no reparations(even for funeral costs) and yet again no justice.
